OLD ORCHARD BEACH, Maine (NEWS CENTER) -- Three weeks after Eric Auger was arrested and charged with criminal restraint on a child the charge has been dropped.

Auger was accused of snatching up a 3- year- old who was outside the Vacancy Pub in Old Orchard Beach on June 22nd.

While under maximum security supervision at the York County Jail police continued their investigation.  Now they say Eric Auger was in the area of Ocean Park Road but he did not pick up or move the child at any time.

Auger's attorney, Bernard Broder says his client was harassed while in jail and threatened by other inmates.  His concern is that Auger will be greeted with similar discontent by community members now that he has been released and the charge was dropped.

Broder says local police are increasing patrols to monitor any retaliation against Auger.  He and his client are also considering a civil suit against the family that filed the complaint.
