Day 5 of Nightingale's murder trial

BANGOR, Maine (NEWS CENTER) -- Nathaneal Nightingale is on trial for the shooting deaths of Michael Miller and his wife Valerie Miller in November 2009 and is facing two counts of murder. 

All week his lawyer has argued that another man committed the crime, the Miller's son, Matthew.  Nightingale's defense attorney, Jeff Silverstein, called Matthew Miller to testify today but he plead the fifth because he thought Silverstein may ask him questions unrelated to his parents' deaths and focus more on his drug use.

We caught up with Miller outside the courtroom and he told us there is no doubt in his mind that Nightingale murdered his parents.  In an audio recording played for the jury yesterday, Nightingale is heard confessing to the killings of Michael and Valerie Miller, and explained how he accidentally shot Michael Sr. in the head while he was showing him a gun he was hoping to pawn.  When Valerie saw her husband dead on the floor, Nightingale said he then intentionally shot and killed her.

"I think it's disgusting," Matthew Miller said. "In Nate's thing when they asked him what kind of person would do this, 'a sick, twisted, disgusting person,' I think what we heard is Nate describe himself.  They're using whatever they can get.  They don't have nothing."

Both sides rested today and because of the holiday on Monday, closing arguments will be given first thing on Tuesday morning at 9.
