BANGOR, Maine (NEWS CENTER) -- For the second time in less than a year, the operators of Bangor's only gentlemen's club are facing eviction.
After landlords evicted Diva's Gentlemen's Club at 190 Harlow Street in August, they're having the same problems collecting rent from the new owners.
It's a dispute that's gone to civil court, as landlord Thomas Brann asks a judge to evict Diamonds Gentlemen's Club, operated by Arayos LLC.
Brann's attorney said Arayos owes nearly $40,000 in rent and other expenses, and hasn't paid the bills since January.
"To withhold and not pay any rent...and here we are five months later, is totally inappropriate and warrants an eviction," said Brann's attorney, Seth Harro.
But according to an attorney for Arayos, it's Brann who owes money.
He said Arayos has put more than $100,000 into the building to bring it up to code -- an expense for which the landlord should be responsible.
Until the company is reimbursed, they will not pay the rent.
The language of the lease is unclear on this issue. It states that the tenant is responsible for paying for repairs they initiate or request.
But the expenses in dispute include plumbing and electrical work, as required by Bangor code.
After hearing both sides, the judge expects to have a decision about the eviction by Friday.
